PHED 6638 - Legal Issues in Physical Education and Sport

Your assignment requires you to be able to locate US Supreme Court cases using a variety of different methods.  You should also be able to locate analyses about the issues in the cases and be aware of the issues as discussed in periodical literature.  Listed below are a variety of resources and tools that can assist you in this process.

Reference Sources
If you are not sure how to begin your research, reference materials can be helpful sources to consult, as they are collections of useful information designed to answer common questions and/or to provide "how to" information.  Depending upon how current and frequently they are used, resources that might fall within the category "reference" may be located in either the reference area or the main stacks of the library.

How Can I Find Reference Sources?

You could browse the reference stacks, located on the first floor of Ingram Library (right next to the research computers), in the KF section, but a more efficient way of finding reference resources would be to do a search using the library catalog.

  • From the library homepage (http://www.westga.edu/~library/), click on either the "catalog" link at the top of the page or the "Search for Books" link on the left side of the page.
  • Type in keywords related to your topic, and limit your search to the "Reference" area of the library by clicking the "Narrow My Search" icon and selecting "Reference" from the dropdown menu under "Location."

Handbooks

Handbooks are a particularly useful type of reference book that may or may not be located in the reference section of the library.

How Do I Find Handbooks?

  • From the library homepage, click on "catalog" or "search for books."
  • Click on the "Keyword" search tab.
  • In the search box, type "handbook" and additional keywords related to your topic (i.e., "handbook legal research," "handbook sports law," etc.). 
  • Experiment with various combinations of keywords.

Fundamentals of Sports Law (2004)

Law of Professional and Amateur Sports (1997)

Addresses legal issues related to both professional and amateur sports.  Each chapter focuses on a specific legal issue and is written by an expert in that particular area of law.  Chapters provide a general overview of the issue, relevant case law, and practice-oriented insight and advice.

Sports and Recreational Injuries (1985)

Analyzes legal aspects of sports and recreations accidents, with emphasis on liability.  Chapter 4 discusses schools' liability.

Sports Law and Legislation: An Annotated Bibliography (1991)

Primary Sources
Primary sources are  records generated by a particular event or time period and produced by those who participated in or witnessed it. Examples of primary sources include interviews, diaries, letters, speeches, results of experiments or original research, literary works, autobiographies, original theories, and other materials.  Primary sources in the field of law include federal, state, and municipal publications, records, reports, and statistics.  Laws, court decisions, and treaties are also important primary documents.  In short, primary documents are original sources that scholars and practitioners in a given field discuss and interpret.  (Note:  these discussions and interpretations constitute "secondary" sources).

The official text of Supreme Court opinions, including any concurring or dissenting opinions.  It has a very unsatisfactory index, but has a very good revolving "Table of Cases Reported" (by either plaintiff or defendant).  This source contains no analyses of the case other than that included in the opinions.

Use West's Education Law Digest (KF 4110.3 .W47-Reference Stacks) for case name or topic access to the Reporter.

  • If you know the case name, find it in the "Table of Cases" to get the citation to the Reporter.
  • Use the "Key Number Digest" for broad legal topic access.
  • Refer to "Colleges and Universities Key Number Analysis" or "Schools topical Key Number Analysis" for detailed breakdown of topics in these areas before using the "Key Number Digest."

This site is an amalgam of public, law school, and commercial providers.  It does include Supreme Court decisions since 1906 and opinions from all federal circuit appeals courts since (generally) about 1995.  It includes law journals and other secondary and analytical resources.  Expect to spend a lot of time here, although what you find may well reward you for your efforts.

Secondary Sources
Secondary sources are records or accounts prepared by someone who has studied primary and secondary sources and has drawn conclusions about the event, person, law, etc. in question.  In legal research, secondary sources include texts that explain, describe, and/or interpret the law.

Periodical Indexes

Periodical indexes provide access to a listing of articles published in a selected group of periodicals (magazines, journals, newspapers).  Indexes may be available in print and/or electronic (database) format. 

  • Paper indexes are usually arranged in alphabetical order by subject or by a combination of subject and authors' names and are limited usually to articles written within a one-year time span.
  • Electronic Indexes (databases) are usually accessible by subject or keyword, by author, and by title of journal, but are able to cover a much broader expanse of time.

Both print and online indexes provide the basic information about an article: the title of the article; author's name; title of the periodical; its volume, issue, date, and page.  In some cases you will also get a summary or abstract and in some cases you will get the fulltext of the article as well.

  • From the library homepage, click on "Databases" or "Search for Articles."
  • Click on the subject area links or type in the name of the database you want to access in the "Find Resources by Keyword" search Window.

Periodicals

All print periodicals are located on the first floor, arranged alphabetically by title.  Paper and microform copies are filed together on the shelf.  Electronic periodicals can be located by clicking the "Databases" link on the library homepage and then navigating to a relevant fulltext database.
